On December 8, the three-judge Bench led by Chief Justice Dipak Mishra rejected the petition filed by primary school teacher Neeta Upadhyay seeking \u2018one nation, one education board.\u2019<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Contradiction_to_Apex_Courts_Views\"><\/span><b>Contradiction to Apex Court\u2019s Views<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">This judgement is a contradiction to a previous view of an apex court. In 2011, a three-judge bench led by Justice J.M. Panchal had upheld the view that a common curriculum will help achieve \u201ccode of common culture\u201d. The popular view was that a common curriculum has the potential to fight fanaticism. However, the judgement delivered fails to <span style=\"background-color: #f6d5d9;\">address\u00a0<\/span>such a scope. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Issues_with_Current_Education_System\"><\/span><b>Issues with Current Education System<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Senior advocate Sajan Poovayya, representing Ms Upadhyay, said the present education system under multiple boards, is failing to provide equal opportunity to students from different social backgrounds. He argued that a common curriculum will uphold the fundamental right to free and compulsory education under Article 21A, which is not being fulfilled now.
